As a result of Hurricane Sandy approaching the New York City area BATS BYX Exchange, BZX Exchange and BATS Options will be closed on Tuesday, October 30, 2012. This was a coordinated decision made with input from the SEC, other exchanges, various Members, and SIFMA in the interest of public safety and maintaining fair and orderly markets. BATS will continue to monitor the situation on Tuesday and provide updates regarding the trading schedule for Wednesday as the situation progresses.

Any further change in operational plans will be communicated via email and posted to the "Schedule Updates" section of the BATS public web-site at http://www.batstrading.com/alerts/.

BATS Notification of System Issue

Dear Member,

Please be advised that BATS has identified an issue impacting certain orders that were flagged as Multiple Display-Price Sliding orders, BOE DisplayIndicator (FIX Tag 9479) = M. Multiple Display-Price Sliding functionality was made available for opt-in on Friday, August 24 and 13 orders have been impacted since the release date. Each affected order apparently did not adjust to a more aggressive price up to its limit price after initial adjustment upon entry. BATS has reached out to impacted Members. Multiple Display-Price Sliding functionality will be disabled until further notice.

Note that effective Tuesday, August 28, 2012, orders sent with BOE DisplayIndicator (FIX Tag 9479) = M will be rejected.

BATS Options Update to Notification of System Issue

Please be advised regarding the following update in connection with a systems issue that BATS Options Exchange disclosed on May 18, 2012. In connection with that disclosure, BATS Options Exchange noted that it had determined that under certain scenarios a risk limit trigger may cause an order to cancel in circumstances in which it could have executed against an incoming order. BATS Options Exchange has confirmed that as currently implemented, a risk limit trigger can cause a resting order to cancel prior to executing in full against an incoming order that is marketable against the resting order subject to the risk limit trigger.

BATS Options Exchange is in the process of modifying this implementation such that an incoming order will execute through a resting orders risk limit trigger before any remainder of the resting order cancels. BATS Options Exchange anticipates this modification to be effective on June 22, 2012. Members may desire to modify their risk mitigation settings under the new systems implementation. Revised specifications will be communicated and available via the BATS Trade Desk the week of June 4, 2012.

BATS Options Notification of System Issue

Please be advised that BATS Options Exchange has identified a system issue that, in rare circumstances, can result in a failure to display an incoming member's quote to OPRA and the BATS PITCH feeds. This situation occurs when an incoming order is priced at the same level as a posted order subject to cancellation as a result of a risk limit trigger. For this situation to occur, the incoming order must also be non-IOC and non-routable.

Analysis has determined that between August 18, 2011 and May 16, 2012, this issue was limited to 348 orders. During this same period, BATS Options handled a total of 35,626,233,564 orders. BATS is in process of reaching out to effected Members with information regarding orders impacted and a patch for this issue will be deployed on Friday, May 25th, 2012.

In connection with investigating the above-mentioned issue, BATS Options Exchange has also determined that under certain scenarios a risk limit trigger may cause an order to cancel in circumstances under which it should have executed against an incoming order. BATS Options is currently assessing the extent of this potential compliance issue in order to deploy a corrective patch and will provide further information in this regard as soon as possible.

BATS Options Exchange (BZX) - Explanation of Delayed Opening in Certain Securities

This morning, the Nasdaq Stock Market experienced systems issues causing a delay in reporting trades to the SIP in Nasdaq listed securities in the M-R symbol range. Prior to accepting orders in an option series, BATS Options Rule 21.7.(a) requires a print from the primary listing market to be issued on the SIP. All BATS Options operated as designed and in accordance with our rules by not accepting orders in the affected underlying securities. When Nasdaq resolved their systems issues and issued prints to the SIP in the affected underlyings, BATS Options began accepting orders as expected.

BATS Post Mortem – Carrier Issue

Dear Member,

Please be advised that due to a significant multiple circuit carrier outage in the northeast, at 15:01:34ET on Friday, January 27, 2012, BATS BYX Exchange, BZX Exchange and BATS Options experienced a network disconnect on their primary network links to the SIPs and OPRA. All SIP connections failed over seamlessly to the secondary path. The majority of OPRA connections failed over seamlessly, however a subset were unable to initially connect to the secondary path. The secondary path to the subset of OPRA connections was established at 15:43ET at which time BATS Options was operating normally.
This connectivity issue also affected routable orders through the primary path to another market center on the BYX Exchange and BZX Exchange. These connections automatically failed over to the secondary path. Any stuck orders caught in flight were electronically cancelled.
The secondary site for the BZX Exchange was also impacted as a result of this carrier connectivity issue. This resulted in market data sourced from the secondary site being unavailable from the commencement of the carrier outage on.
All BATS primary site systems are operating normally. Secondary site systems will operate normally on Monday, January 30, 2012.

Orders that should have been represented in penny increments were instead represented in nickel increments on the 9th. The issue was corrected for trading on January 10th, 2012.
