BATS BYX Exchange Post Mortem

Please be advised that starting at the regular market open, BATS BYX Exchange experienced an internal network disruption that resulted in Member order entry disconnects and internal multicast network drops. The root cause was a bug in a network vendor's software used to ensure redundancy between a pair of switches. Thus, the failure rendered both redundant switches intermittently unstable.

While troubleshooting the issue this morning, BATS determined the bug could recur during the current trading day out of Weehawken, NJ. As such, the decision was made to fail trading over for the remainder of the day to the secondary datacenter in Chicago, IL. Trading for BYX Exchange was enabled via Chicago at 12:40:00PM ET and continued from the secondary site for the remainder of the day.

The BATS Network Engineering team will be implementing corrective action to permanently work around the vendor's software bug this evening while ensuring redundancy. Trading for the BYX Exchange is expected to commence tomorrow (Friday, September 27, 2013) in the primary datacenter in Weehawken, NJ subject to rigorous testing of the permanent work around this evening. BATS fully expects BYX Exchange systems to operate normally out of Weehawken, NJ tomorrow.

BATS BYX Exchange FIX Sequence Update

Please be advised that if a member connects to BYX Exchange FIX sessions in Chicago with a higher sequence than what they left off with when trading was enabled at the primary data center, BATS will automatically attempt to use the sequence reset procedure. Please be advised that as a result of human error on Monday, July 1, 2013, two securities were active and trading on BATS BYX Exchange, but quotes for those securities were not disseminated to the applicable securities information processor ("SIP"). The two impacted securities were Twenty-First Century Fox, Inc. Class B (FOX) and Twenty-First Century Fox, Inc. Class A (FOXA). The issue was corrected yesterday after the close.

Please be advised that the brief matching issues experienced on BATS BZX Exchange at the open this morning lasted for anywhere from 48 seconds to 83 seconds and were a result of a series of issues on Matching Engines containing ETFs listed on BATS.

The root cause of this issue has been identified and will be corrected after the close.

During the issue this morning, the impacted Matching Engines automatically failed over to our backup Matching Engines. Any open orders on the impacted books at the time of the issue were automatically cancelled followed by an automated restart of matching on a secondary Matching Engine.

Fail-over of the symbol ranges impacted occurred during the following timeframes:

Post Mortem - BATS BZX and BYX Equities Intermittent Network Issues

Please be advised that the intermittent connectivity issues early this morning on the BATS BZX and BYX equities exchanges were a result of a network configuration change made the previous evening. Network routing issues within BATS network infrastructure resulted in sporadic Member disconnects to TCP based order entry and market data feeds which were primarily resolved at approximately 9:20AM ET. After that time, certain Members continued to report isolated issues on specific TCP ports. BATS worked directly with the few remaining impacted Members on their port specific issues and as of 10AM ET, all issues were resolved.

Dear Member,

Please be advised that, as announced January 9, 2013, BATS has determined that upon an NBBO update on BATS' BYX Exchange, BZX Exchange and BATS Options, there are certain cases where the Matching Engine will allow for a trade through or an execution of a short sale order at a price that is equal to or less than the NBB when a short sale circuit breaker is in effect under Regulation SHO. These cases result from the sequencing of certain required events in the Matching Engine related to re-pricing and sliding orders in response to the NBBO update.

REVISED (1/25/2013): After further analysis, BATS has determined that more than 97% of the originally reported executions were not trade throughs under Rule 611 of Regulation NMS because they involved trades through quotes that had existed for less than one second or were priced below $1 and were within $.01 of the protected quote. Consequently, less than 12,000 trades have been confirmed to constitute trade throughs under Rule 611 across all three BATS US markets during the affected period. The updated numbers are below.

In the first case, a visible order that is posted and has been price slid can execute at a price that trades through another market center's protected quote if that away market center locks the displayed price of the BATS order and then BATS receives another order that crosses the working price of the resting order.

In the second case, the system was programmed to allow non-displayed peg orders to re-price in response to a change in the NBBO prior to sliding previously booked contra-side hidden orders that now cross an away market center. As a result, it is possible that in response to a change in the NBBO, the price of a resting hidden order could be crossing the NBBO momentarily and an execution could occur at that crossing price against a peg order that is re-priced in response to the NBBO change, resulting in a trade through. This particular issue can also result in a short sale order executing at a price that is equal to or less than the NBB while a Regulation SHO circuit breaker is in effect.
