BATS Announces Updates to BZX IPO Auction Process for BATS-Listed Corporate Securities

Pending SEC Approval, BATS BZX Exchange (BZX) will reduce the complexity of the IPO Auction process by limiting the number of allowed order types that are accepted for an IPO Auction in a corporate security. New Issue Auctions for newly listed ETPs will be unchanged. During an IPO Auction, only Limit and Market orders will be allowed to participate. In addition, other select order modifiers will be ignored or converted to other values when an order is entered in an IPO Auction. Finally, pending SEC approval, BZX will calculate and enforce Limit Up/Limit Down (LULD) bands until the LULD bands are received from the SIP while also rejecting all orders on the EDGA, EDGX, and BYX Exchanges until the LULD bands are received from the SIP after the IPO auction. Effective, Tuesday, May 31, 2016, BATS EDGA Exchange and EDGX Exchange will no longer support the Direct Edge (DE) Compatibility Mode FIX protocol. On the effective date all Member FIX ports that are in DE Compatibility Mode will be disabled until the Member has successfully certified for FIX V2 and requests that the ports be switched to the BATS V2 protocol. BATS BZX Exchange and EDGX Exchange Expansion of Support to Send Orders to Halt Auctions on the Primary Listing Exchange Postponed to December 4, 2015

Today, ROOC orders on the BATS BZX Exchange and EDGX Exchange will send to the primary listing exchange in the event of a symbols halt for inclusion in the halt auction. Effective Friday, December 4th (previously scheduled for release November 13th), the BATS BZX Exchange and EDGX Exchange will support sending all routable non-ROOC orders to the halt auction on the primary listing exchange. BATS will provide port-level support allowing a member to default all routed orders, regardless of routing strategy, as eligible to participate in halt reopening auctions. Currently, BATS BZX Exchange, BYX Exchange, EDGA Exchange, and EDGX Exchange begin accepting orders at 6 am ET and matching and routing orders at 8 am ET. In addition, the provision which requires that there be crossing limit orders on one or both sides in order to perform an auction at a price other than the Volume Based Tie Breaker will be removed. Finally, BATS will update the handling of Late Orders to use the NBBO rather than the ZBBO when calculating the BATS expects these changes to improve the auction experience on the BZX platform for our Members through increased executions, while also delivering improved logic around the reference prices used for BATS Auction Collars to prevent erroneous auction prices. BATS Announces Plans to Launch EDGX Options, a New Customer Priority/Pro Rata U.S. Options Exchange

BATS is pleased to announce the filing of rules to launch a second options exchange EDGX Options with the Securities and Exchange Commission (SEC). EDGX Options will be based on a customer priority/pro rata allocation model and is designed to complement the existing fast-growing BATS Options market, which will now be called BZX Options. The launch of the new EDGX Options market will enable BATS to compete for a new segment of order flow that does not trade on the price-time markets that BATS currently operates. EDGX Options is expected to launch in November 2015, pending SEC approval.

BOE users must upgrade to BOE v2 in order to receive the FeeCode field. Note that the BOE v1 AccessFee field associated with FIX Tag 9621 will be NULL (0x00) filled on the effective date.

BATS Announces Order Persistence on Matching Engine Failover

Effective immediately, BATS is pleased to announce we will begin offering Order Persistence in the event of a Matching Engine (ME) Disconnect or Failover. This opt-in functionality is configurable at the FIX/BOE session level and is available on BYX Exchange, BZX Exchange, EDGA Exchange, EDGX Exchange and BATS Options. The feature provides Members with the ability to have resting orders persist and remain live on the book after a primary matching engine fails. The current and to be maintained default behavior is for all orders to be cancelled in the event of a matching engine failover. In the event a matching engine failover takes longer than 5 minutes all orders will be cancelled regardless of the session level configuration. However, a typical ME failover takes less than 1 minute. Members that would like to enable Order Persistence on ME Disconnect on their order entry ports may request the change through the Logical Port Request form within the BATS Member Web Portal.

BATS Announces Duplicate Order Protection

This functionality will provide Members with the ability to prevent duplicate orders from entering a BATS trading platform when a user-defined number of orders with matching Side, Price, Quantity, and Symbol have been accepted during a configurable period of time. BATS Announces Fat Finger Protection Enhancement

BATS is pleased to announce that on Friday, February 6, 2015, BATS will make a change to the behavior of Fat Finger Protection, which is available on all BATS Equities and Options exchange platforms. On the effective date, Members will be able to configure Fat Finger limits using both percentage-based limits and dollar-based limits where previously only a single percentage-based limit was allowed. Additionally, BATS will add the ability to apply different Fat Finger limits across six distinct limit price ranges to allow members flexibility in setting up Fat Finger Protection. Statement Regarding Todays SEC Announcement vs Direct Edge; Conference Call To Be Held Tuesday

BATS Global Markets today announces the conclusion of two separate investigations into the development of order types; one relating to BATS and the other relating to Direct Edge. With regards to BATS, the Securities and Exchange Commission (SEC) has concluded its investigation with no action taken, and we are pleased to have this matter formally closed. With respect to Direct Edge, the SEC is taking an enforcement action against the legacy Direct Edge exchanges with respect to functionality that was implemented prior to the acquisition by BATS. We have agreed to enter into a settlement agreement with the SEC, without admitting or denying the allegations, in order to put this matter behind us. The SEC did not allege that there was anything inherently inappropriate about order type functionality at Direct Edge. Rather, the SEC alleged that Direct Edges price sliding functionality was not completely and accurately disclosed in Direct Edges rules. We have cooperated with the SEC staff throughout both investigations, and want to thank the staff for their thoughtful consideration and discussion of the relevant facts and policy issues.
